General Terms and Conditions of B2B Sale
ARTICLE 1 – OBJECT AND B2B NATURE OF THE CONTRACT
1.1. These General Terms and Conditions govern the B2B (Business-to-Business) sale of products through the Vintagism.eu website.
1.2. Sales are exclusively reserved for professionals, companies, and holders of a valid VAT/EORI number. Consumer protection laws (including the 14-day right of withdrawal) do not apply to these transactions.
ARTICLE 2 – “QUOTE REQUEST” PROCEDURE AND CONTRACT FORMATION
2.1. Step 1 (Quote Request): Submitting an order request through the checkout DOES NOT constitute a binding sales contract. It is a preliminary request to verify item availability and calculate shipping logistics. No payment is captured at this stage.
2.2. Step 2 (Final Quote): Vintagism will calculate the shipping costs based on volume, weight, and destination, sending the Customer an updated quote containing the final total.
2.3. Contract Conclusion: The B2B sales contract is deemed legally concluded only upon the Customer’s acceptance of the final quote and subsequent payment. If the Customer rejects the quote, the request is canceled with no obligations for either party.
ARTICLE 3 – PRICES AND SHIPPING COSTS
3.1. Prices displayed are ex-works and DO NOT include shipping costs, transit insurance, or import/customs duties.
3.2. Shipping costs are manually calculated post-checkout and added to the final quote. Customs duties and local taxes for international shipments are the sole responsibility of the Customer.
ARTICLE 4 – PAYMENT AND INVOICING
4.1. Orders are processed only after full payment is received via the secure link provided in the final quote.
4.2. A regular commercial invoice will be issued using the VAT/EORI details provided by the Customer during the checkout process.
ARTICLE 5 – SHIPPING AND RISK OF LOSS
5.1. Delivery times are estimated and non-binding. Vintagism is not liable for delays caused by couriers or customs.
5.2. The risk of loss or damage to the goods passes to the Customer upon delivery by the carrier. The Customer must inspect the goods immediately upon arrival and sign the delivery note “subject to inspection” if packaging is damaged. Claims for transit damage must be reported within 48 hours.
ARTICLE 6 – RETURNS AND WARRANTIES
6.1. No Right of Withdrawal: As this is a B2B transaction, returns for buyer’s remorse are not accepted.
6.2. Vintage Condition: Items sold are vintage, antiques, or second-hand. Normal signs of wear, age, and minor restorations are intrinsic to the products and do not constitute defects. All items are sold “as is”.
ARTICLE 7 – PRIVACY POLICY
7.1. B2B Customer data is processed according to the GDPR (EU 2016/679) for administrative, fiscal, and operational purposes related to order fulfillment.
7.2. Vintagism may use the provided email to send B2B commercial updates related to similar inventory, from which the Customer can opt-out at any time via the unsubscribe link.
